DISPUTE RESOLUTION AND GOVERNING LAW

a) Governing Law: Any dispute between Dinar Exchange and you shall be governed according to the laws of the State of Nevada, and all activities performed in connection with the use of the Website including purchases/transactions shall be deemed to have been performed in Nevada. Any controversy, dispute, or claim arising out of or relating to the use of this Website or the transactions with Dinar Exchange shall be governed by and construed in accordance with the laws of Nevada, except that body of law governing conflicts of law.

b) Disputes with Dinar Exchange: If a dispute arises between you and Dinar Exchange, our goal is to resolve the dispute to the satisfaction of all parties in a cost-effective and efficient manner, therefore you are required to contact Dinar Exchange in writing at least 30 days prior initiating any legal proceeding or arbitration. Failure to do so will constitute a material breach of this agreement.

c) Arbitration: For any dispute/claim (excluding claims for injunctive or other equitable relief) where the damages are less than $10,000.00 USD, the party requesting relief may elect to resolve the dispute in a cost-effective manner through binding non-appearance-based arbitration. If a party elects arbitration, that party will initiate such arbitration through an established alternative dispute resolution (ADR) provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

d) Forum for Disputes: Except as otherwise agreed by the parties or as described in section 11(c) above, you agree that any claim or dispute you may have against Dinar Exchange must be resolved by a court located in Clark County, Nevada. You agree to submit to the personal jurisdiction of the courts located within Clark County, Nevada for the purpose of litigating all such claims or disputes.

e) Improperly Filed Legal Actions: All claims you bring against Dinar Exchange must be resolved in accordance with section 11 of this Agreement. All claims filed or brought contrary to section 11 shall be considered improperly filed, and a breach of this Agreement. Should you file a claim contrary to section 11, Dinar Exchange shall recover attorneys’ fees and costs (including in-house attorneys and paralegals); provided that Dinar Exchange has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.

TERMINATION

Dinar Exchange may cease to operate the Website at any time with or without notice. Dinar Exchange reserves the right to terminate your access and use of any part of the Website at any time without notice for any reason.

MISCELLANEOUS

Entire Agreement: This Agreement constitutes the entire agreement between you and Dinar Exchange pertaining to the subject matter hereof and governs your use of the Website and the transactions between you and Dinar Exchange superseding any prior agreements between you and Dinar Exchange pertaining to the subject matter hereof.

No Waiver: The failure of Dinar Exchange to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision.

Severability: If any provision or term of these Terms and Conditions is found by an arbitrator or court of competent jurisdiction to be invalid, the parties nevertheless agree that the arbitrator or court should endeavor to give appropriately valid effect to the intention of these Terms and Conditions as reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect.

Modification: We may modify these Terms and Conditions from time to time without notice to you, except as may be required by law. It is your responsibility to review the most current version of the Terms and Conditions by reviewing this Website. You may terminate your use of the Website/services and stop making transactions with Dinar Exchange if you do not agree with any modification or amendment. If you use the Website or make any transactions with Dinar Exchange after the effective date of an amendment or modification, you shall be deemed to have accepted that amendment or modification. You agree that you shall not modify these Terms and Conditions and acknowledge that any attempts by you to modify them shall be void.

Once we receive your order it will be authenticated and verified within 3-7 business days and we will mail you a company check. This process may take up to 7-21 business days during times of high volume. Once your shipment has completed authentication/verification we will normally ship your order within 24 business hours, however it could longer during times of high volume. Please Include in your package a copy of your photo ID, any documentation showing where you purchased it from. Failure to provide these items will result in delayed processing. Dinar Exchange can hold your funds for 120 business days once we have limited your account in disputes.

Prices Subject to Change

Dinar Exchange reserves the right to change its prices at any time, without prior notice.

Authenticity

Iraqi Dinar have a number of security features designed to thwart counterfeiting, and we have taken steps to confirm the authenticity of your banknotes.

Circulated vs. Uncirculated

Uncirculated Iraqi Dinar is Dinar which should be in pristine condition and appear as if “fresh from the mint”. Iraqi Dinar that is not in sequential order will be deemed by us as circulated. Uncirculated notes should have sharp corners and sharp edges, no bends or folds, no pen or pencil marks. The notes should look brand new. Circulated notes are generally pretty worn, have pen and pen marks and is not in pristine condition, circulated Dinar could also be Iraqi Dinar that is in pristine condition, but that is not in sequential order.

Compliance

Please include a clear photocopy of your Government issued Driver’s License in your package as well as copies of your original receipts of purchase. Failure to do so will delay the processing time of your order. You order will not be processed until these documents are received.

Condition of Items Sold

We pay $750 per million for new, latest series print (2013-2015 series), uncirculated Iraqi Dinar and $725 per million for older print (2003 series) uncirculated Dinar, or $500 per million for circulated Iraqi Dinar. The Seller is fully responsible for making sure that they are exchanging the correct series of banknotes. We will hold you to our terms and conditions and all transactions with us are final and non-negotiable.

Additional Terms of Service

Dinar Exchange reserves the right to cancel any order and ship your Iraqi Dinar back to you, if applicable, at any time without prior notice. By sending Iraqi Dinar to us, you hereby agree to allow Dinar Exchange to submit your name and other personal information to state, federal and international government authorities such as Interpol and United States authorizing agencies through SDN (the Specially Designated Nationals list) to meet OFAC, Bank Secrecy Act, Patriot Act and other relevant regulatory requirements. Dinar Exchange may, under certain circumstances, contact you to confirm that the information which you have provided to Dinar Exchange is accurate or to request supplemental information and may take such other steps to assist in verification of the information you have provided to Dinar Exchange. Failure to provide such information when requested may result in the cancellation of your order. By making a purchase you agree to and are hereby bound by these Terms of Service.
